1. Overview and acceptance

This website is operated by Freaks4Figs Inc., a business in Florida, United States. Throughout these Terms of Service, “Freaks4Figs,” “we,” “us,” and “our” refer to Freaks4Figs Inc. “Service” means this website and the information, tools, and features we make available through it.

By accessing or using the Service, you agree to these Terms and any additional policies expressly made applicable to your use. If you do not agree, please do not use the Service. These Terms apply to visitors, customers, and anyone who submits content to us.

2. Our Shopify store

These Terms are prepared for the planned Freaks4Figs online store on Shopify. Shopify Inc. will provide the e-commerce platform and checkout infrastructure that allow us to offer our products and services online.

When you purchase from the Freaks4Figs Shopify store, your purchase is from Freaks4Figs Inc., not Shopify. Freaks4Figs Inc. is responsible for its product listings, customer service, fulfillment, and store policies. Shopify and other service providers may have separate terms and privacy notices that apply to their services.

3. Online store terms and eligibility

To place an order when purchasing becomes available, you must be legally able to enter into a binding contract in your jurisdiction. Minors may use the website only with the permission and supervision of a parent or legal guardian.

You must comply with applicable laws and must not use the Service or any products for unlawful or unauthorized purposes. You must not transmit viruses, malware, or destructive code. Product age recommendations, safety warnings, and manufacturer instructions must be followed; some collectibles may contain small parts or be intended for adult collectors.

6. Changes to the Service and prices

Product prices may change prospectively. The applicable product price, currency, taxes, shipping charges, and any other disclosed charges will be shown in the Shopify checkout before you complete a purchase.

We may change prices or discontinue products prospectively. Changes do not override rights arising from an already accepted order or applicable consumer law.

7. Figures, trading cards, toys, and collectibles

Freaks4Figs focuses on figures and collectibles, including trading cards and die-cast toys. Availability may be limited, and reasonable purchase limits may apply when clearly disclosed.

Review the product description for the item’s identity, dimensions, condition, packaging condition, included accessories, and any stated grading or authenticity information. Do not assume an item is sealed, mint, professionally graded, or accompanied by particular accessories unless the listing expressly says so. Screen settings may affect displayed colors, and any representative images or illustrations should be identified as such.

We do not promise that trading-card packs contain a particular card, rarity, or resale value unless a listing expressly guarantees a specific item. Collectibles are not offered as an investment, and future market value is not guaranteed.

Brand names and product trademarks identify their respective owners. Their appearance on the website does not imply sponsorship, endorsement, or affiliation with Freaks4Figs Inc.

8. Orders, billing, and account information

When placing an order through our Shopify store, you must provide accurate and complete contact, billing, and shipping information. Keep any customer account credentials secure and update your information as needed so we can fulfill your order and contact you.

Orders may be reviewed for inventory availability, payment authorization, suspected fraud, or disclosed quantity restrictions. Order status and acceptance will be communicated through the checkout and order notifications. If an order cannot be fulfilled or must be corrected, we will contact you using the information provided and handle any payment already taken in accordance with applicable law and the published purchase policies.

Payments are submitted through the Shopify checkout and the payment services made available there. Available methods and provider terms will be shown during checkout. Do not send payment-card details by email or through ordinary customer-service messages.

9. Shipping, returns, cancellations, and preorders

For preorders, review the listing for the expected release timing, payment arrangements, and cancellation terms. Estimated release dates are not guaranteed delivery dates. Our Return Policy sets out the 30-day claim window, eligibility conditions, return shipping responsibilities, and refund timelines. Cancellation and preorder-specific payment arrangements must be confirmed and published before launch.

Nothing in these Terms removes any mandatory rights relating to defective, damaged, misdescribed, or undelivered goods.

10. Third-party tools and links

The website may use or link to third-party services. Those services may have their own terms and privacy practices, which you should review before using them. We do not control third-party websites or endorse their content merely by linking to them.

Shopify supports the planned store’s e-commerce operations. Additional payment, delivery, or other service providers may be used as disclosed in checkout or our policies. Their involvement does not change Freaks4Figs Inc.’s responsibilities to you as the seller.

11. Comments, feedback, and submissions

If you voluntarily send feedback or submit a review or other content, you retain ownership of your content. You grant Freaks4Figs permission to use, reproduce, and display it as reasonably necessary to respond to your feedback or operate the feature through which it was submitted. This permission does not transfer ownership or override your privacy rights.

Submit only content you have the right to share. It must not infringe another person’s rights, contain unlawful or abusive material, include malware, impersonate someone, or misrepresent its origin. Shopify and the payment services selected at checkout may process information in connection with their services. If you email us, we receive the information you choose to include.

It must be reviewed against the actual store configuration before launch. Information may occasionally contain typographical errors or omissions relating to product descriptions, prices, promotions, shipping, transit times, or availability. We may correct those errors and update information as permitted by law.

For any purchase affected by an error, we will communicate the issue and handle the order and any payment consistently with applicable consumer law. An update to one part of the website does not mean every other part has also been reviewed.

14. Prohibited uses

You must not use the Service to commit or encourage unlawful acts, infringe intellectual-property rights, threaten or harass others, discriminate unlawfully, submit false or fraudulent information, impersonate another person, or collect someone else’s personal information without authorization.

Your access to the website does not grant ownership of that material or a license to commercially reuse it, except as expressly permitted or allowed by law.

16. Disclaimer of warranties

To the extent permitted by applicable law, the website and online shopping services are provided “as is” and “as available.” We do not guarantee uninterrupted, error-free, or continuously available access, or that every error will be corrected.

Any product warranties or express promises will be described in the applicable listing or purchase documentation. Nothing in these Terms excludes warranties or other consumer protections that cannot lawfully be excluded.

17. Limitation of liability

To the extent permitted by law, Freaks4Figs Inc. and its personnel and service providers will not be liable for indirect, incidental, special, or consequential losses arising from use of, or inability to use, the Service, including lost profits or data.

These limitations do not apply where prohibited by law and do not exclude liability for fraud, willful misconduct, gross negligence, or any liability or remedy that cannot legally be limited. Any final sales-specific liability provisions require legal review before real purchasing is enabled.

Termination does not eliminate obligations already incurred or affect any rights to refunds or other remedies required by law.

These Terms, together with policies expressly incorporated and made available to you, govern use of the Service and supersede prior versions concerning the same subject. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.

We may revise these Terms by posting an updated version on this page and changing the “Draft updated” date. For material changes, we will provide any additional notice and obtain any consent required by applicable law. Changes will not retroactively remove rights arising from an already accepted purchase.
